SAN ANTONIO- A 36-year old woman and her husband were walking to their car from Luminaria downtown Saturday night when the woman was hit and killed by a SUV.

Police say a truck ran a red light at the intersection at north St Marys and west Travis Street and hit the SUV knocking it onto the sidewalk hitting the couple. Catherine's brother Chris Rios says his brother in law suffered minor injuries but says his sister died a short time later from internal injuries.

Chris Rios said, “My sister was pinned against the railing and she was coherent and talking and when they moved the car back she collapsed and that's when she went unconscious.”

Police say the driver of the truck was given a sobriety test and was not intoxicated. Police are calling it an accident and the driver will not face any charges.

I was there and feel like this was reckless homicide or involuntary manslaughter. You have a responsibility to obey traffic laws and if you fail at this responsibility (purposefully or not) you are responsible. Not only do I send my love and condolences to Catherine's family, but also to the driver of the CRV as he was victim too and will have to live with the images of what happened; although not at fault he was extremely remorseful and full of anguish.

Last I checked, running a red light is breaking the law. Why are no charges being filed?

It makes me wonder who the driver was. No charges, thats quite a slap in the face to the family. People should be screaming about this. Condolences to the family.

@Superspurs, we're not in an election year so the DA's gonna blow it off until it's time to get re-elected, then he's going to pretend he's tough on crime by railroading some innocent on trumped up charges just to save his job.

No charges? Uhm... Seriously? That's outrageous! :( The guilt the person who caused her death must be feeling. My condolences to the family of the lady.

Simply outrageous! If I was the husband and some idiot ran a red, killed my wife, and got off with no charges... well, I'll just say that he might be safer in prison!

WTF is this about? The guy ran a red light, hit another vehicle, then that vehicle killed this woman. Last time I checked we had a DA.

The truck driver should be facing some type of charges. They did break the law by running a red light and that resulted in someones death. That is not an accident!

Regardless of the fact that the driver was not intoxicated, does not mean that his/her negligence doesn't extend to negligent homicide. We need to make drivers take responsibility for their actions, sober or otherwise. This is ridiculous.

No charges and the man ran a red light and killed someone just doesn't sound right. The person should be charged with vehicular manslaughter due to fact he broke the law by running red light.
