Warrant issued in horrible sex assault case

LIBERTY, Texas (AP) -- An arrest warrant has been issued after a man being tried on charges he took part in the repeated sexual assault of a young Texas girl didn't come back to court after a break.


Testimony continued Wednesday in the trial of Eric McGowen despite the 20-year-old's absence. A court official says state District Judge Mark Morefield is drafting a bench warrant for McGowen's arrest.


McGowen didn't come back after an afternoon break that followed the testimony of two co-defendants who pleaded guilty in the case. One said he didn't see McGowen have sex with the girl but did see him sexually assault her. The other said he never saw McGowen sexually assault the girl.


McGowen is one of 20 men and boys accused in attacks on the girl.

it sounds like david is trying to justify his having sex with a 10 year old...either that or he's a sicko attorney

Thank you, YumBrandz. I actually checked the dictionary for the spelling before I typed it, so all I can say is typo, and I need new reading glasses. It's a bit difficult to admit the creeping age problems. And, then again, it could be mental failure (age again) in thinking it had to be one letter, even though my dictionary told me differently. Whatever........thanks for the correction!!!

DAVID........I've read the story you reference below, and it really has nothing to do with the discussion on the rape case, other than trying to make a point regarding age and consent and culpability. For the case in question of the rape....what part of video evidence do you not understand? Several of the defendants have already pled guilty to "reduced" charges, been sentenced, and testified in this case (he was found guilty, by the way). Granted, they "ratted" for a lesser sentence, but that was on top of the video evidence, which supported the victim's claims. Actually, I've read that two of the three testifying admitted to watching the defendent abusing the victim with the bottle, but stated that they did not witness him physically raping her. Why are you so adverse to accepting that this actually happened? I KNOW that false rapes are claimed daily all over the country. I know that kids have learned how to use that as a weapon against a teacher or a parent, WITHOUT FULLY UNDERSTANDING THE REPERCUSSIONS, or maybe not caring. But, the evidence put out there in this particular case is horrific and blatant. Video evidence cannot be denied, even if the victim acquiasced in the end.

What a horrible story, since this guy is such a threat to little girls they would have put him in a cell or put him in shackles. Rape must be a low priority for Texas Law.

to protect young girls such as this who probably got roped in by this one guy telling her how pretty she was then luring her to a place where she could be raped by 20 guys... a kid picking up a firearm at 15 and shooting another human being is way different than a child being lured into a situation where they get raped.

Well I didn't know about the bottles part. And 20 guys is a bit much. But I was speaking in the general sense about these underaged sex cases, not this particular case. If a 15 year old "child" can be treated like an adult and sent to prison for life, then why can't that 15 yr old be treated like an adult and have sex with whomever they want to? The courts claim that the 'child' is capable of making adult decisions and can suffer adult consequences when it comes to committing crimes. But that same person cannot make adult decisions when it comes to sex. (Certainly 11 is too young. And I am not using this case here as an example.) Why do we allow one but not the other? How can you be adult enough to go to prison for the rest of your life, but not adult enough to be able to sleep with someone??

@David: I think you've got your stories crossed. This little girl was hispanic and she never received any money. It was a clear case of rape. Your comments are disgraceful. So shocked by your comments. How sad that people in our society feel this way and go on to find guilt in an 11 yr old innocent girl that was repeatedly raped.
