Toxicologist says Ybarra was above the legal alcohol limit

SAN ANTONIO- For the first time the public saw SAPD video of the accident that killed 23-year-old Erica Smith as it played out in court.  It was part of testimony in the Jenny Ybarra intoxication manslaughter trial.  The video is from a helicopter dispatched to the scene on December 16, 2007.  The officer flying told the court he was dispatched for a wrong way driver and a possible fatality.  A toxicologist also testified that Ybarra had a blood alcohol level of .13 which is above the .08 legal limit.  Testimony in this case will resume on Monday.

I've been watching this trial. She has blamed her actions on everything from TXDOT and their confusing freeway system to her C-section she had before the accident to her failing relationship with her guy. Maybe she should mention the facts that she was drunk, driving the wrong way on the freeway and in the middle of the night and killing a girl that was just driving home.
