Teen could face murder charge after deadly gunfight

SAN ANTONIO - A man is dead and police say a teenager could face murder charges after a shooting outside an apartment complex on the north side. It happened outside the Canlen West Apartments in the 3500 block of West Avenue.
 
Witnesses told police it was around 9:30 p.m. Monday night when a fight broke out between 24-year-old James Whitley and a 15-year-old male. Authorities believe Whitley fired a shot that grazed the teen in the head.  Police said the 15-year-old returned fire, striking Whitley.

Whitley later died at University Hospital.
 
The teen is expected to recover.  Police say he could face murder charges, but as of Tuesday morning that had not been determined.

From other sources, this was a drug deal gone bad. If so, ghen it is Capital Murder. I for one would make the 15 yo prove beyond all doubt that the elder fired first.

Murder? I would sure like to hear the Police explain how they get to murder when all the kid did was shoot back. Maybe the kid threatened the older guy and went out to stalk him, but if the facts only show the kid shot back then murder seems a long way away from self defense.

Good Lord. Does anyone else feel like they've stepped into the Old West?? Every day it gets worse. Every day there's some "gunslinger" just waiting with a gun to pull the trigger. Next thing will be holsters and horses...

Seriously? Why murder? The other guy shot at him first and he returned fire. The only difference is that the older guy missed and the younger one hit the target. I dont condone the fact that this teenager carries a gun, however, he did and he return fire only after his life was threaten; therefore, its SELF DEFENSE!

A 15 year old has no business being in possession of a firearm, but under the circumstances, sounds like self defense to me.
