Teacher's aide accused of choking 8th grader

SAN ANTONIO -- Cuts and bruises mark 15-year old Brandon Yee's neck. He says he was choked at Kirby Middle School as punishment for being tardy.

"I had sprained my leg so I was walking slow," says Yee. "The teacher was complaining because I was walking slow so I was like, 'I sprained it'. So he thought I was playing with him."

The school district confirms there was an altercation Monday morning, but wouldn't go into details.

But News 4 WOAI caught up with students who witnessed the alleged assault.

"[The teacher] grabbed him, he threw him against the wall and dragged him 10 to 15 feet and [Brandon's] shoe came off," describes Esmeralda Lopez, who was sitting in the class at the time.

Esmeralda says another teacher approached her in the hallway and told her not to tell anyone about the incident.

"They try to hide everything," says Esmeralda's mother, Christina. "It got me upset they told them not to say anything about it."

The teacher's aide is no longer with the school. Though students allege other teachers were inside the room, the district would not confirm that or comment on whether other employees have been disciplined.

I support the Aide in this case. These kids today are scum and this kid is scum for sure.

You know it's always the teachers fault. Cause they are all "Good Boys & Good Girls" and misunderstood. Might be another case of Fetal Alcohol Syndrome.

Pretty baby; please let your husband know that he is a true patriot and hero for serving our country and giving us the right of freedom of speech. I too served for 22 years in the active Army and just retired last year. I gave you and many others this right as well for 22 years and never complained. By the way "loosers" is actually losers; I learned this after getting my second MBA.

A former classmate of the victim told me that the two of them would get in trouble all the time. He also said this guy probably deserved it.

All these "think I'm a hard a$$" kids need to be shown that the adults in charge of them are the BOSS! If my middle schooler pulled any crap like that, rest assured any wrong doing would not go unpunished and school punishment too. My husband and I both attended Kirby Middle School and Judson. This may be a lower middle class area, however ones financial status cannot and should not affect thier parenting. I CAN'T STAND LOSER PARENTS" if they are even called parents!

This kid is a punk. He attempted to hit the aide, before he put his hands on this punk. They start young and everyone makes excuses for them. Teachers and staff don't have a chance. A student hits us and we can't defend ourselves because an adult can't put a hand on a student. The fact that he is 15 and in middle school says a lot about this loser
