San Antonio woman dies in officer involved rollover accident

San Antonio --  A San Antonio family is grieving tonight. Their mother was killed in a rollover accident early Sunday morning. It was an accident that also involved a San Antonio police sergeant who was driving home from work.

The police report says both drivers are to blame for the fatal accident. Sergeant Gabe Trevino failed to yield the right of way. But investigators also say Rosita Davila failed to use evasive action. That means she didn't do enough to prevent the accident. Her family says that just doesn't seem right.

The news of Rosita Davila's death is just starting to set in with her family. Her daughter, Sylvia Paez, tried to hold back tears as she spoke about her mother's life.

"She was a sweet, hard working lady," Paez told News 4 WOAI.

Rosita Davila worked as a house keeper for nearly 30 years. Sylvia said her mother had just started to enjoy her retirement.

"She was just out for a night of dinner and movies and was on her way home,” Paez explained. “Then this terrible, terrible accident happened.”

The police report shows Rosita Davila was already on Loop 1604, heading west. Sergeant Trevino was in his unmarked patrol car trying to merge onto the highway. At one point, the report shows, both vehicles were in the same lane. The sergeant claims Davila hit him. But a passenger inside her Jeep told investigators she clearly remembered the police car hitting her side of the Jeep, causing them to lose control.

Sylvia Paez told us she’s sure her mother wasn’t at fault, "My mom was the most careful driver. You could check her driving record. No tickets, no accidents."

Rosita Davila's family says police haven't released a lot of details to them about last night's accident. But the one thing they do know is who was driving this police unit that hit their mother’s car.

"Mr. Trevino, you owe our family a big apology,” Sylvia Paez said. “Because only God knows that it was not my mother's time. It was not her time to go. She still had a lot of life. And you owe us that much."

Sergeant Gabe Trevino is a 21-year veteran with San Antonio police. At the time of the accident he was driving an unmarked police unit and was in uniform. Right now he's administrative duty pending the outcome of an investigation.

News 4 WOAI has confirmed San Antonio police investigators have no plans to file charges against anyone.

Everyone is talking about SAPD taking care of their own. Heck yes they take care of their own. They are a family! Do you honestly think that the people were in the car with the women who died aren't going to say whatever they have to in order to protect her? That's part of it.

it's the way that SAPD is handling the case that's making the news ppl, not based solely on the fact that an SAPD officer caused the death of an elderly woman.

Libsocal, my comments were directed to JCinSa for partially blaming the poor women. Yes it was an unfortunate accident, but to partially blame the lady who had the right of way is B.S. The patrolman had a history of driving incidents, including his wife...read the other news article. Libsocal, read the comments the SAPD said, "THE LADY WAS PARTIALLY AT FAULT FOR NOT TAKING EVASIVE ACTIONS". Now if that is not partially blaming the lady...what is it? Can you please explain how that is NOT partially blaming the lady. She had the "RIGHT OF WAY". Again, it was an accident....but man up when you make a mistake!!!

I don't think anyone is blaming this lady, most are saying it was an ACCIDENT!! An accident that almost all drivers have had...and the day it happens to any of you fools who are talking smack I just hope the ignorance of people saying horrible things about you doesn't hurt your feelings. I HOPE when it does happen to you some nice people will actually defend your UNINTENTIONAL actions,,,,SAVAGE, you might want to listen...karma has a way of showing you how it can happen to anyone

JCinSA you have to be an idiot and moron to even partially blame the lady. She has the right of way PERIOD. Now if she or anybody wants to move over to let drivers merge, that's great, but that is not required. That didn't cause the accident, what caused the accident was Gabe NOT YIELDING. It looks like Gabe has been in trouble before due to his driving habits. Don't even think the poor lady was at fault, you idiot. I realize that some drivers slow down to let you merge into traffic and some don't. But the important question is who is supposed to yield? The person already on highway or the one getting on the highway? It is so easy....even a caveman could figure it out? Can you?

I had no intention to make things up. As the articles are being updated, I am unable to locate the mysa article that mentioned which lane she was in. If incorrect, then I retract that point, but you can't take back your callous remarks.

This guy should retire and work security for Wal-Mart. If it was my family member i'd be pissed,simply because the person intrusted to enforce the laws of this great country should be held to a higher standard. that's just the way it is .They always cry and say that they don't get paid enough but the fact is you can make upwards of 100grand without a degree.

I am not a professonal driver nor claim to be one ... but shame on SAPD for blaming the woman WHO LOST HER LIFE for not using evasive action. Anything to protect your own, eh?
