POLL: Should school be allowed to require pregnancy test?

DELHI, La. - A publicly-funded Louisiana school is reconsidering a controversial policy after the American Civil Liberties Union called it into question.

Delhi Charter School in northeast Louisiana keeps pregnant girls out of class and can make any girl suspected of pregnancy take a test to check.

The American Civil Liberties Union says that violates laws against sex discrimination. It has threatened to sue unless Delhi Charter School changes the policy.

The school principal says given the ACLU's inquiry, he is having the policy reviewed by lawyers. The school will revise its policy to ensure it fully complies with the law. Classes start at Delhi Charter on August 15.

ACLU state executive director Marjorie Esman says the school's lawyer wrote Tuesday, saying the policy is being reviewed. She says she takes that as a sign that the school is taking the letter seriously.

The "Student Pregnancy Policy" takes up four paragraphs in the school's 216-page policy manual. It says pregnant students must study at home or leave the school. It says the requirements are part of "an environment in which all students will learn and exhibit acceptable character traits."

Delhi Charter School's policy states the school seeks to maintain an environment where students will learn and exhibit acceptable character traits that govern language, gesture, physical actions and written words.

"The school reserves the right to require any female student to take a pregnancy test to confirm whether or not the suspect student is in fact pregnant," the policy reads.

The policy also allows the school to refer the student to a physician of its choice. "If the test indicates that the student is pregnant, the student will not be permitted to attend classes on the campus of Delhi Charter School."

Pregnant students wishing to continue attending Delhi Charter will be required to enroll in a home study course while pregnant.

"They're punishing girls for making the choice to have the child," Marjorie Esman, executive director of the ACLU of Louisiana, said Monday.

Students who refuse to take a pregnancy test are "treated as a pregnant student and will be offered home study opportunities."

The letter from the ACLU contends that the policy violates Title IX of the Education Amendments of 1972 because it excludes students from educational programs and activities based on sex and the equal protection clause because it treats female students differently than male students and relies on impermissible sexual stereotypes.

Esman said the policy is a pretext for sexual discrimination.

Caroline Roemer Shirley, executive director of the Louisiana Association of Charter Schools — of which Delhi Charter is a member — said that all public schools, including charter schools, must abide by federal law.

"Perhaps the school was not aware of the protections under Title IX (of the Education Amendments of 1972)," she said. "I am feeling a bit frustrated that maybe not all of our schools are aware of these compliance issues. I hope they will remedy this or explain why they think they have the ability to do this."

I like Phrilly's idea, but I think they should do away with the pregnancy tests and just test for STDs, but that's probably an invasion of privacy, but if the school wants to keep their morals??..

They should do drug testing on anyone receiving governemnt aid/funding. This would include all school students and anyone on welfare programs.

These are good Christan people, upright and righeous, who have bravely defied the Devil and his people in, of all places, Louisiana, which is mostly a pit of sin and debauchery. They have stood up to the wicked and insisted on Christian principles. Naturally, they have become a target of the Devil's people. I imagine the satanic Justice Department of the God forsaken Federal Government will soon join in the attack, threatening these good people with assault by their ATF, IRS, New Black Panther Party or other terrorists. We must pray that these good people are able to hold out for Christian values against the hoard that is to come against them and, if they are defeated, we must make sure there is a place for them here in Texas. I believe that is what Jesus would counsel.

I think the key here is that it is a publicly funded school. If it were a private school, it would be different.

This BS is a violation of the HIPPA act and a gross violation of the girls constitutional rights. I don't know how the PUBLICLY FUNDED school has gotten away with this as long as they have.

If they require a preganancy test on the females then they have to test the boys for STD's. What's good for the goose is also good for the gander.

The word needs to be put out that teen pregnancy is NOT acceptable. It is NOT ok. Unfortunately this is exactly opposite of the message that is currently being sent by those running the education system. Time for that to change. Direct election of school superintendents would help.

This is exactly what is needed. It's time teen pregnancy stops being rewarded and celebrated. It's amazing how we're all surprised when 10 more girls in a class suddenly get pregnant after the first one starts showing (aka girl_zero). If you don't like the rules of this charter school, go somewhere else. Now I do think if daddyboy is found to attend the school also, he should be expelled. School is for reading, writing, and arithmetic, not baby raising.
