SAN ANTONIO - SeaWorld may head to a higher court as it fights for the right to have trainers in the water with killer whales during shows.
A judge ruled that trainers could not be in tanks during performances after a trainer was drowned by a whale in 2010.
SeaWorld appealed the decision, saying trainer and whale interaction makes a more compelling show for the park's main attraction.
On Monday, federal safety officials took no action on the appeal. SeaWorld has less than 60 days to decide if it should take the case to the U.S. Court of Appeals.
