No charges for father who beat sex assault suspect to death

SHINER, Texas-- A 23 year old father who killed a man suspected of trying to sexually assault  his 5-year-old daughter won't face charges, said Lavaca County District Attorney Heather McMinn.

The announcement was made in a press conference at the Lavaca County Courthouse in Hallettsville, Tuesday afternoon.

"The Lavaca County grand jury has met and has not returned an indictment," replied McMinn.

At the press conference authorities played a chilling 9-1-1 call the frantic father made to an operator asking for help. "I need an ambulance, this guy was raping my daughter and I beat him up, and I don't know what to do, " said the father on the tape.

Investigators said it was back on June 9th the 23-year-old father beat 47-year-old Jesus Flores to death on the family's rural ranch outside of Shiner. The father caught Flores attacking his little girl.

"The substantial amount of evidence showed that the witness statements and the fathers statement and what the father had observed was in fact what had happened that day, " said McMinn.

McMinn went on to say under Texas law deadly force can be used to stop a sexual assault.

Despite beating Flores, the young father was desperate to get him help.

For several minutes the father is on the phone pleading with the dispatcher to find them.

"This has been a traumatic event as you can imagine in their life, " said V'Anne Huser, the attorney representing the father.

Huser addressed the media saying the family wants to put this tragedy behind them.

"There's a 23 year old young man who is a peaceable soul and if you met him you would know that, he's a peaceable soul and he had no intention to kill anybody on that day, " replied Huser.

@ustill apparently you dont know law enforcement protocol. Anytime a person dies especially at the hands of another, a thorough investigation is performed. The ME issues the cause of death and the investigation is opened. Once all the facts are examined it is presented to a grand jury and indictments if any are handed down. In this case its justifiable homicide.

No, ustillnvme: You are the one that doesn't understand. Local law enforcement, TEXAS RANGERS, 911 tapes, and medical evidence all came together to prove to the Grand Jury and the county prosecuter, that the child's father was just and honest in the events that happened and that he didn't intend to kill the man abusing his 5 yr old daughter. Oh, crap....I just finished reading your comment and see that you went back to the same BS that you posted yesterday. You are a useless piece of human flesh and a trouble making troll. There IS a special place in HELL for the likes of you!!!

I don't think there are many who wouldn't have done the same thing in a fit of rage to see someone attacking your child. prayers to both families...

By doing what he(father) did, he did society a favor and took this SOB out and prevented some other child from getting hurt. The father did the right thing. I hope he reads all these comments and sees the support he is getting. Bless you all.
