CONVERSE, Texas -- Police say a man will not face charges for shooting a suspected burglar over the weekend, and we've learned late Monday that the two suspects are just out of Judson High School.
A spokesperson for the Converse Police Department says a woman ran to her neighbor's house for help around 4:20 p.m. Saturday after she arrived home and spotted a burglar inside her house on Anderson Court. As the neighbor came out of his house with a gun, the burglary suspect took off. Reportedly, the driver of the getaway car tried to run him over with a vehicle. Police say the neighbor fired shots at the vehicle, hitting one of the suspects in the left arm.
Officers said they caught up with 18-year-old Robert Sedberry, Jr and 18-year-old Justin Leal, at Loop 1604 and Old Seguin Road. Leal was taken to a hospital for treatment and is expected to be all right. Police say he faces charges of Aggravated Assault with a Deadly Weapon and Burglary of a Habitation, while Sedberry, faces Burglary of a Habitation charges.
Police are calling the shooting a case of self-defense.
We spoke with Leal's family today, which contends that police did not catch up with their son until he'd reached Northeast Methodist hospital, and interrogated him there. They also say their son was never in the home, but was outside at all times. Finally, they tell News 4 WOAI that he did not try to run over the homeowner, therefore, they claim, they homeowner could not have been acting in self-defense.
We have learned more about the two suspects. Sources in Judson school district tell us that Sedberry played football with the Rockets all four years he was in school, but was "in and out of trouble." He was a starter this past season, but did not finish the season with the team. They tell us Leal played football and baseball his freshman and sophomore year.
Investigators said there was also a second suspect involved in the burglary. That man, 18-year-old Robert Sedberry, Jr., faces charges of burglary of a habitation.
