Was a designated crosswalk with a "walk" signal being used? If so, and something tells me one or both were not based on the critical nature of the one man's injuries, then this may have never happened and the person driving the car could have been held responsible for not yielding right of way to pedestrians. BUT that hinges on whether the pedestrians were within their right of way parameters (desingated crossing with "walk" signal), and of course common sense dictating to watch out for jerks who disregard that rule while speeding along like it's Tokyo Drift. Good point, akhenaten.

Do not assume that you have any right-of-way if you're a pedestrian as it can be costly.
