Actually the legal age of consent is 17 as on 2012 and its a 3 year rule or a 5 year rule.

In Texas the legal age of consent is 18. However there also is a 5 year rule, that is the offender is less that 5 years older than the other, there is no crime. Where this case got out of hand was the photography. nude pictures of her is also a felony and if in his possession, that is another felony for child porn. At any rate this guy is in trouble and can face a lot of hard time. It does not make any difference if she instigated it, she cannot legally give consent.

I realize that most people don't think that extra-marital sex is a big deal, but a lot of our laws are based on the premise that it is immoral and harmful. Outside of marriage, the age of consent varies from state to state, but it is usually 16-18. Above that age extra-marital intercourse is merely tolerated, not something that is encouraged by the spirit of the law. At the same time, inside of marriage it is a different situation. For example, several states have no minimum age requirement for marriage. In those states all that is needed is parental consent, approval from a local judge, and maybe some court-ordered premarital counseling. It's possible for two people who are barely teenagers to marry, or for an adult to marry a child, but the hurdle is high to cross...as it should be. So in the present case, ol' Joshua would have had no problems if he had gone through the proper channels and just married her. The "Age of Consent" laws wouldn't have applied in that case. Of course he would have had to convince this girl's mother that marriage to him was in her daughter's best interest...
