GARDEN RIDGE, Texas -- Bullets flying into a subdivision have residents scared to walk outside their front doors.

Police believe the rounds are stray bullets coming from a nearby firing range in Garden Ridge. Residents said since bullets started flying into homes and yards and whizzing past joggers more than a year ago, they've been trying to get the firing range shut down.

The Bracken Rifle & Pistol Range has been on the outskirts of Garden Ridge for 25 years. Then in 2008, developers built the Wild Wind subdivision less than a mile away and right in the line of fire. Wild Wind HOA President Bob Shilliday said he's received 20 complaints of stray bullets littering the neighborhood. Four homes have been struck, including one that has been hit twelve times.

"I'd be appalled if I lived over there," said Garden Ridge Mayor Jay Feibelman. "If I knew I couldn't sit on my patio if there were bullets flying in."

Mayor Feibelman told News 4 WOAI that because the range is outside city limits, his hands are tied.

"And I'd go further and say if it was in the city, they're not doing anything illegal, and We can't prove it, how would I, as the mayor of city council, do anything," Mayor Feibelman added. "We can't shut them down."

But that's exactly what the homeowner's association is asking for. In fact, last year the HOA and the firing range split the cost for an unbiased ballistics study. The expert recommended the range make several changes to keep bullets from leaving the facility. Shilliday says the range hasn't complied with those recommendations.

The range's attorney denies the bullets are coming from the range and said the subdivision was built and residents moved in with full knowledge of a nearby range.

The investigation is now in the hands of the Comal County Sheriff's Office. Investigators told us there are also hunting areas nearby, and they're still trying to determine if the bullets are, in fact, coming from the shooting range.

I realize our first reaction these days is to defend 2nd amendment rights. I'm with you! Absolutely. But it folks like the operator at Bracken Range that is endangering this right for all of us. There is a responsibility to contain the rounds fired. He's not doing so and ALL the facts support that. The range was found by a independent review to have numerous saftey violations. He agreed to fix them and then defaulted on his commitment. There is a solution that meets everyone's needs but he is electing not to implement it. Perhaps it is because he knows that he doesn't have any liability if someone is injured...the shooter does. So today he is electing to give the homeowners the finger and when someone is injured he will give it to the shooters. For those of you who think this is similar to the noise of an airport. Not exactly. Its more like the landing gear falling off the airplane that just took off and landing in your house. I'm pretty sure I knew about the noise...I just had no idea parts of the plane were going land on my house! At the end of the day, either the safety measures will be implemented or someone will get hurt. If it's my wife, I'll miss her...but at least I'll own a former gun range!

I guess you are advocating that it is OK for bullets to go off the range property and that the range owner should not be responsible for meeting the safety guidelines set up by the NRA that acknowledge that operators should operate their ranges in a safe manner. How about charging the people on FM2252 who drive everyday in the line of fire of the rifle range.....let's collect a toll. Safety should be the range owners responsibility.

I've seen this played out time and time again only with the military. Bases are in desolate areas. Builders build close to the bases and then, planes can't fly; training can't be done, etc...really? Go after the stupid builders and developers and city planners. They are the ones that did this, not the homeowners or the gun range. These houses should never have been put there in the 1st place.

I had a friend that lived out in Bulverde and had a few cattle and some horses and some city family built houses moved out there and started to complain about the smell and how it it brought flies to their house. People move out to the country and try to bring the city with them. If you don't like the smell or the flies or what every the country has move back to the city. Please.

Lets not forget the idiots who buy homes at the end of a runway then scream bloody murder about the noise. "Sir/Madam. Was the airport there before you bought the house? Did anyone try to hide the airport, say by covering it with a sheet? Can you read a map? Get out of my court before I lose it and laugh in your face. Same goes for those storefront churches that move in next to a bar/adult shop then sue to have the business close because it is within XXX of a church/church school. And the neighborhoods. If you are too stupid to check to see what is around the place you plan to live in for the safety of your family, then you are too stupid to live.

Kid: "Mom, I'm going out in the back yard to play." Mom: "Don't forget your Kevlar dear."

Let's not forget about the people who bought homes near the rock quarries and then complained about the blasting.

FYI...WOAI got it wrong... We don't want the range shut down, we want the safety issues addressed and fixed. Is that seriously too much to ask??? Or does someone need to get shot for some sort of action to happen? What's also sad is that the folks shooting from that range have no clue that if someone is struck with a bullet and it's traced back to them, they’ll face criminal prosecution...NOT the gun range. (Ask your lawyer, I'm not making that up!)

I used to go to this firing range. It's been years, but I remember there being a huge hill behind the targets to stop the bullets back then. How bad of a shot must someone be to have the bullets go past that?

To those that say it was there already, if they were complaining about noice, then that is a valid argument. But dangerous items are leaving someone's property and going onto anothers. If you moved into a house that had messy neighbors, and then the mess ended up in your yard, do you just say oh well they were here first?
