Rios has been on administrative leave since July 26.
Her absence centers around a picture of the teacher and her dance team students. The photo was taken last year on the River Walk at Dick's Last Resort restaurant.
Someone tagged Rios in a Facebook photo that some people consider inappropriate.
The board took no action on Rios' employment status during executive session Monday night. The board addressed the audience saying the decision will be left up to the interim superintendent Rey Madrigal.
A spokesperson for Harlandale ISD said the superintendent will contact Rios regarding her future employment status. A decision could be made as soon as Tuesday.
