Man murdered after accidentally killing two kids

HOUSTON (AP) - A Texas man whose two young sons were killed in a traffic accident has been charged with murder in the fatal shooting at the crash scene of a suspected drunken driver.

Brothers David Jr. and Caleb Barajas were helping their father push their broken-down pickup truck when a vehicle driven by 20-year-old Jose Banda plowed into them. The December accident happened just 50 yards away from the Barajas' rural Houston-area home.

Banda was later found shot. Brazoria County sheriff's investigator Dominick Sanders says witnesses saw David Barajas Sr. next to Banda's vehicle when shots were fired.

Barajas has been indicted for murder and was being held Monday in the Brazoria County Jail on a $450,000 bond. Court records did not list an attorney for him.

Medical Examiner needs to certify the cause of the DUI driver's death as "lead poisoning". Let the father go!

If the courts would do their civic duties and lock up DUI offenders, this may not have happened. I am willing to bet the driver had prior DUI's.

This seems like temporary insanity rather than murder. Drunk driver manslaughter should be up graded to second degree murder. People who drink and drive should be held accountable. They know what they are doing. And some poor innocent has to pay the price while usually, these people walk away unscathed. I don't blame this gentleman at all. I say the 20 year old got just what he deserved. He'll never drive drunk again.

Curious to know what the penalty is for drinking under age since a 20 year old shouldn't have been able to drive drunk .... Sad to hear this family has been ripped apart but such a selfish person.

Karma can be a b*tch! The 20 y/o DUI, paid the appropriate price (eye for an eye), IMHO. Too bad the dad is going to do some time in the pokey. But he should have waited until Mr. DUI had spent a few years in the Pen as Bubba's love sponge... then extracted his revenge, after the parole.

You can't blame his for this it was temporary insanity ,any one would be capable of what he did if their children were just murdered by a drunk driver , if I get picked as a juror he is free in my book .
