SAN ANTONIO -- A man was shot to death while he was fighting with his brother over the volume of the music at a party early Sunday.
Christopher West, 25, was having fun at a party at his house while surrounded by family and friends. Moment’s later, a fight broke out between Christopher and his 21-year-old brother Jeffrey. Jeffrey claims the fight was broken up when their roommate shot his brother in the back.
Police say the roommate 25-year old Justin Moore, told them Christopher had a knife during the scuffle. A police report states Jeffrey confirmed Christopher had a knife in his hand when the two began arguing but told officers he was not sure what happened to it and that his brother must have dropped it.
Christopher and Jeffrey's mom Cindy Ochoa believes her son was murdered and says she wants justice.
“He shot my son, from what I understand, two feet away, with a shot gun,” Christopher and Jeffrey's mom Cindy Ochoa told us.
“My brother and I were real close," Jeffrey explained. "We fight. We fought before, but, I mean, I don't need anybody to interfere with my stuff."
Jeffrey, Christopher, and 25-year old Justin Moore all lived together. The family said they knew each other well.
“He knows that he wasn't going to hurt him," mom Cindy said. "He wasn't going to hurt Jeffrey when they were fighting and scuffling there. He knows that he wasn't going to do anything. They live together. All of them they live together.”
Police did question Moore, but no charges have been filed.
