"No Refusal" adding to the backlog of DWI cases

Since 2009 the Bexar County has seen an explosion of DWI cases where blood was drawn to measure alcohol levels.

On any given day, Judge Jason Wolff's courtroom is packed with people trying to get their cases through the system. Wolff is just one of several judges battling a backlog that was partially created by the "No Refusal" program.

Last October Bexar County decided to go "No Refusal" 24-7. So, if police believe you're drinking and driving and pull you over you have two choices: Take a breathalyzer test or have your blood drawn.

"What initially happened when they were going to do the mandatory blood draws, it was thought it would actually drop,” Mike Lozito, Bexar County Judicial Services Director explained. “[We thought] that individuals would see it, you know, they have the blood draws, and they would probably do more of the breathalyzer test. But that didn't happen."

In 2009 Bexar County had 367 cases where blood was drawn from the suspect. Under the new initiative that number has been multiplied by ten, with 3,655 blood draw cases in 2012.

More cases mean more work for the Bexar County Medical Examiner's office. They tell us it takes an average of 41 days to process a blood draw from start to finish. But the District Attorney's office and some county judges paint a darker picture, saying it can take closer to 90 days to get the evidence back.

"The medical examiners office, generally, their purpose is death investigation. And so with them having the toxicology lab there, that's where the blood draws kind of fit in there. So, they're not a production shop,” Lozito said.

Lozito adds being short-staffed has also contributed to the delay.

“The faster we get those results, the better it is for everybody,” Assistant District Attorney Cliff Herberg told us.

He'd like to see the process speed up; but says, in the end, having concrete evidence in hand is worth waiting for.

“It's a temporary delay so we can get a better result. It's better for the defendants in the form of justice, because obviously you don't want to convict somebody who didn't do something wrong. The blood test tells the story,” Herberg noted.

I say, ANYONE that refuses a breath test, no matter what, should have to pay for their impounded cars, because they force the city to do a blood draw, therefore THEY CHOSE to have their damn cars impounded!!! Damn Drunks SHOULD pay for EVERYTHING they CAUSE.

KUDOS to SAPD !!!! Make the DRUNKS PAY for the testing, and EVERYTHING involved!!! Keep these DRUNKEN SLOBS OFF OUR ROADS!!! I Back the BLUE!!!

Keep up the "NO REFUSAL"....it may someday save one of your loved ones' lives. I hate drunken slobs...literally cannot stand a drunk!!

And if the blood draw is found to be negative does the city refund the impound fee you paid to get your car back and any other expenses you incurred? Didn't think so. The blood draw is for money not safety. You can not have drunk any alcohol, and you get an a***e cop, and there are some, he takes you in and BAMM you have an impound fee.

how are drunks doing it? its not drunks backlogging everything.. its the slow asses at the medical examiners office. they need to get more government dollars to hire more ppl. its their fault for ASSUMING that people where going to take breathalyzer tests.. you know what they say about assuming things..

P.S. Another misleading headline. It’s not “no refusal” that’s adding to the backlog of DWI cases…it’s DRUNKS!

I think you miss the point, @Stabzz, of why a lab test is better for the innocent than a breathalyzer test. I have personal knowledge of several people who use an inhaler for asthma, and that will show a false positive on a breathalyzer test. Blood draws, however, will tell the truth conclusively. I know that the intent of “no refusal” was NOT to protect the innocent, but how about this? How about if the city uses some of the excess funds from the STUPID “pre-k” tax to send lab tests to contract labs? The ME’s office shouldn’t have to do these at all. Furthermore, I’d like to know what percentage of those blood draws comes back positive for excessive alcohol. That’s the real test of how effective these are. Oh, and here’s an interesting bit of information, @Jackhammer. I used to feel as you do but I’ve spoken to cab drivers who REFUSE to haul a drunk around in their cab, because 90% of the time, the drunk is going to puke all over the cab and cost the cabby much more than the fare is worth. It puts the cabbie out of commission for about 24 hours or so, besides the expense of having the cab cleaned. Actually, @Superspurs might be on the right track!

Just execute one drunk driver who kills someone and your problem drops 50%.

If you do go out and drink, GET A CAB!! I know it sucks to get a cab or whatever, pay 30+ dollars but IF you get pulled over your going to wish you got a taxi. Your gonna wish that you paid the 30 40 50 hell even 100 dollars to take a cab home. Go out drink get drunk and play it safe, take a taxi home.

DWI has really become a problem here in San Antonio. And the death fatality is out of control. People don't drink and drive. Stay home get drunk. I want to be safe out there!!!!
