SAN ANTONIO - The News 4 WOAI Trouble Shooters have confirmed SAPD Det. Michael Tucker passed away from a heart problem over the weekend. Tucker was assigned to the Wrecker Unit where he was the department's point-man on towing issues for many years.
Tucker was set to testify in the trial between the city and Bexar Towing which was scheduled for Tuesday, November 27th, in municipal court. The trial date was delayed late Monday.
Bexar Towing is challenging the city's towing ordinance that caps towing fees at $85, plus tax, storage and impound, for a maximum charge of $128.25.
The city attorney's office says both sides decided to delay the trial, but not because of Tucker's death. The city says the trial will likely be re-scheduled for a date sometime in the next two weeks.
Bexar Towing wants Municipal Court Judge Robert Lipo to dismiss more than 400 tickets SAPD wrote to towing companies for over-charging under the ordinance.
The city attorney's office says while Tucker would have testified at the trial, it has actual over-charging victims who will still take the stand, as well as other officers who can testify about over-charging incidents.
