Centex sues two local companies - Blames them for retaining wall collapse

Millions of dollars were spent by the subdivision's builder, Centex, repairing the wall and buying back 22 homes. Now, in the lawsuit, they are claiming they weren't responsible for the collapse. Centex says two local companies are to blame.

lol I do not understand why the homeowners think they are entitled to some of that money.

Why should the homeowners get some money? Didn't they buy back the 22 homes. GREED....The wall has been fixed and if they had out of pocket expense because of the wall I agree, go after the company that designed and contructed it.

Oh...that is hilarious! The wall is owned by the HOA. "When Centex bought back the homes, they bought into the HOA...(with the)right to sue companies who designed/constructed...If they win, homeowners probably won't see a dime of that money." The HOA didn't even see it coming or see what hit 'em. The HOA wasn't as smart as they thought they were, were they?

They can attempt to recover their "losses" through arbitration; they don't have to go to court. They can sue the builders of the wall. Their property values are falling - not because of the wall collapse - but because they paid $180,000 for properties that are really only worth about $60,000. If that. The other great error they made was to even consider living in a development that has a Home Owners' Association. Nothing reduces the desireability of a development as much as one of these valueless, blood-sucking, mandatory membership, associations.
