SAN ANTONIO -- A San Antonio doctor is weighing in on a new state law that helps make sure mothers-to-be carry their babies to term.

Dr. Margaret Kelly supports House Bill 1983, which was signed into to law this past legislative session. The new law says if a woman is on Medicaid and is induced for labor before 39 weeks just because she wants to be, then the hospital and the physician will not be paid.

"A patient, decides, demands to be delivered at 37 weeks, just because she is tired of being pregnant, can't be admitted to any labor and delivery unit in the state of Texas," explained Dr. Margaret Kelly.

It's estimated the move could save more than $1 million in neo-natal intensive care costs for the state.

But we want to hear from you. What do you think about this law? Click on "Add a Comment" below to tell us.

Actually human babies are born usually at 8 1/2 -9 1/2 months 40 weeks is not an excact sience more like an adverage but over all it is a woman's choice and devine will isnt true either if we were made in gods image then we have a choice to do what we want too we just have to take good with bad.

Not allowing a baby to go full term by the mother is a selfish act. I am a father of 2 twin boys born at 26 weeks. Let them grow!

I really agress with this! Women need to realize its about the baby not the momma...I have been pregnant twice and understand how hard it gets at the end but we have to stick it out for the long hall :) I dont think this should just be for medicaid! I am a hard working mother who was on medicaid when I was pregnant and I know alot of people have a sterotype about medicaid but there still are some good women who dont milk the system. Women with private insurance get to make there own descions and women on medicaid should me able too! If your gonna take from 1 take from all!

Besides, God has determined the gestation period for a human child and who are we to mess with Divine Will?

DrPhil: Keep government control out of my womb!!!! There are a lot of problems in our society, but giving our government so much control of things, especially personal things such as this, is heading much too quickly toward Socialism, or worse. And, who's to choose what mothers are "unfit & irresponsible"? Track record has shown that CPS can't handle the job, so....who? And why? Explain what qualifications make one capable of being that judge. You can't make a blanket statement like that for a number of reasons, including our personal rights and freedoms. Don't get me wrong.........I detest the state of our society when children & our elderly are so horrifically abused & murdered. But, what you're suggesting isn't a rational answer. Unfortunately, finding the rational & correct answer is still pretty elusive. I, personally, think that there's a grave problem with a majority of our society today that I do have my personal ideas about as far as a beginning toward a solution, reasoning, etc., but I hesitate to discuss it.

I think the lawmakers should stay the he!! out of it. This is an issue between a woman and her doctor.

How about passing a bill that requires birth control and mandatory steralization of unfit and irresponsible mothers and fathers.

Ok first, batman, you have it all wrong. the gestation period is approx 10 mths...hence 40 weeks! For my comment, I have to have my child induced at 38 weeks because of a medical reason. Plus the doctor was going out of town during my 40th week but he felt it was better that I induced because he did not want me to run the risk of losing baby. If there is a medical reason then yes....otherwise, you shouldn't have gotten pregnant! use protection....but SA doesn't know how to do that being the highest pregnancy rate city in the USA! Believe that!~

Just let nature take its course... unless there is a medical reason to induce

Having a baby is never convienent. They should NEVER induce labor prior to 40 week unless the baby or mother are having problems that require it. It is too easy to be wrong on the due date and hae serious issues.
