Smile Center sued by parents

A chain of dental clinics here in San Antonio is hit with a massive lawsuit filed by parents who took their children to The Smile Center.

The court action is more fallout from my investigation into the clinics and allegations it did unnecessary work at taxpayers expense.

The lawsuit filed Wednesday on behalf of 23 children alleges the Smile center would routinely recommend unnecessary and excessive dental services.

The lawyer filing the suit says this is the first of many to come as they prepare to file on behalf of one-hundred children.

“The lawsuit alleges and we intend to prove with substantial evidence that a lot of the dental care received by these children was unnecessary and improper”, says Attorney Tom Crosley.

The lawsuit was filed against The Smile Center, owner Dr. Stephen Simpton and former Smile Center dentist Dr Mark Hong.

It alleges Smile Center and its dentists would – “recommend unnecessary and excessive dental services, most commonly consisting of pulpotomies (baby root canals) and stainless steel crowns".

I saw plenty of those silver crowns during my investigation last February when I first uncovered parents complaining about what they say the clinics did to their children.

Many parents told me some of those crowns had fallen out and in some cases their kids got infections after the work was done and paid with tax dollars from Medicaid.

The lawsuit goes on to allege “The smile center subjected these children to its production machine for one primary reason -- to bilk Medicaid for its financial gain".

The suit also alleges the clinics made $55 Million from Medicaid from 2008 to 2010.

That's more than twice what I reported earlier this year.

“We will ask a Bexar County jury to access responsibility for this conduct to prevent continuing harm to children and to the Medicaid system we all pay into,” said Crosley.

The lawsuit makes lots of other allegations, including that The Smile Center routinely restrained children during dental work in a way it describes as “barbaric”.

It goes on to allege The Smile Center threatened to report some patients to Medicaid who did not show up for their appointments. And the lawsuit claims clinics did work without proper consent from parents.

The Smile Center is already the target of a civil and criminal investigation by the Texas Attorney General's Office. Although the attorney for the clinics claims the investigation is just a routine audit.

We tried to reach Dr. Stephen Simpton's attorney late this afternoon and left a voicemail, but have not heard back for comment on today's lawsuit.

FYI, These so called marketing agents market low end areas like retail locations such as goodwill stores, and small grocery stores around public housing areas as well. They prey off the people and schedule unnecessary appointments for children who have chips and medicaid. Horrible we should demand that all goodwills remove these ruthless people from marketing to children to bilk the government and taxpayer money.

You know it's funny. I took my daughter in there with private dental insurance and we barely got through a routine check-up. She already had tooth sealants done and had 1 cavity. When I went to set up a follow up appointment to get the cavity filled they never called me back to set it up after several attempts to set up the follow up. I got a phone call a month ago after 2 years (and I had seen the trouble shooters report about all of the other kids infections from other work done) I told them we found another dentist and mentioned this news report, the woman promptly hung up. So I'm not sure if they have something against private insurances that they can't milk...but that's just how it seemed to me.

Agree with upyours808. The money should be paid back to the system and if there is any monies left over it should be put in a 524 College Fund for the children to be able to further they education when they get older. Hopefully break the cycle of being taken care of by the system. Very doubtful but one can wish the Entitlements will one be used by the people that need it the elderly and the disable.

When a dentist recommends unnecessary work and the parents can't afford such it doesn't matter what the dentist says. I bet most of these parents did not pay anything out of their pockets as most were chip or some federal program. When as a parent, if it doesn't cost you a dime you're going to "want" the best for your kids. Therefore, this lawsuit should be to recoup the monies paid back to the taxpayers just like upyours808 stated.

Agree with upyours808. Since we were also the ones who were ripped off, then we should have the money paid back into the system. Sorry for those families that had this happen but you do need to repay us although SOME money should be owed to the children (not the parents who would squander the money off on some TV). Any money that is divided out to the families should be taxed to include past welfare services owed and money should be given in the form of a fund for the child (since this is who it happened to) for future educational opportunities.

upyours808-i agree. the money should be paid back to the medicaid system and the rest put in an account for the kids to use when they are 18 yrs old. that's what they did with my neice. all the dental clinics advertisement are for chip and medicaid patients. the name "ghetto mouth"because of all these kids under 5 yrs old with silver caps on their teeth.

The TAXPAYERS need to get some of those monies BACK! NOT the families that have received this service. These families receive or received WELFARE benefits people, should not get ANYTHING, not a penny. They lived off of US the TAXPAYER'S. This lawsuit should be brought on behalf of the State of Texas ("the TAXPAYER'S")and should be paid back. These attorneys had just found another way to rip-off the TAXPAYER'S!! Bunch of scammer's. Just saying.....
